TUTICORIN PORT TRUST
In exercise of the powers conferred by section 123 of the Major Port Trusts Act, 1963 (38 of 1963), the Board of Trustees of the Tuticorin Port Trust makes the following Regulations, namely:-
1. Short title and commencement:-
(1) These regulations may be called as Tuticorin Port Trust (Issue of Entry Permit for Vehicles, equipment and Persons) Regulations, 2005.
(2) These regulations shall be applicable for entry of vehicles, equipment and persons into Port area in Zone 'A' and Zone 'B' These will not apply to the ships' crew(Foreign) and the Foreign nationals entering the Port.
(3) These regulations shall come into force on the date of publication of the approval of the Central Government in the Official Gazette.
2Definitions:-
(a) "Port area" means, the area defined as
"Port Limit" including the roads, open space and the
(b) "Board" means , the Board of Trustees of the
(c) "Chairman" means, the Chairman of the Board of Trustees.
(d) "Traffic Manager" means, the officer for the time being in charge of Traffic Department of the Tuticorin Port Trust and includes his Deputies and Assistants and any other officer acting under the authority of the Traffic Manager.
(e) "No Parking Area" means, the area where a board with the words "No Parking'"is put up .
(f) "Overspeed" means, the speed of the truck beyond the speed limit indicated by a display in any place on the road/Wharf/ Dock Area
3. Regulating the entry of persons into Port restricted area-
(i) All persons entering the security gates in Zone 'A' and Zone'B' shall be restricted entry through issue of entry permits by the Traffic Manager.
(ii)The type of entry permit to be issued and period of validity etc. shall be decided by the Chairman.
(IIIEntry permits shall be issued on tendering the requisition by the organization/agency in their letter head indicating the name of person , designation, purpose of entry, the period upto which the entry permit is required etc.The letter should be under the signature of authorised person of the firm/ company.
(IV) On authorization of the same by the officers concerned in the Traffic Department, necessary fee as per the Scale of Rates shall be paid in the Photo Pass Section for obtaining the entry permit. The entry permit shall be visibly displayed at all times and shall be produced for verification when demanded by the Security/Traffic personnel.
(V) After the validity period is over, the entry permits shall be surrendered while applying for fresh entry permits.
(VI)If any entry permit is lost, for obtaining a fresh one, the individual concerned shall produced a Police complaint receipt issued by the concerned Police Station.
(VII)The requisition for issue of fresh photo permit shall be made with the office of the Traffic manager.
4. Regulating the entry of vehicles/equipments etc. -
(a) Entry of all vehicles including light vehicles and two wheelers into the Port Security Gates shall be restricted by issue of vehicle entry permit (Licence) for periods mentioned in the Port scale of Rates and on collection of necessary entry (licence) fee. The period of the permit shall be decided by the Traffic Manager
(b)For issuing entry permit for vehicles, documents will be verified for ascertaining the following requirements.
(I) Registration number of the vehicle
(ii) Insurance validity period
(iii) FC period
(vi) Pollution under control certificate.
(c)In the case of equipment, besides the above certificates obtained from the competent authority under the Dock Safety Regulations like Form-II, Form-IV and Form VI shall also be produced.
5. Violation of Licence conditions :
(a) In the case of entry persons, the following acts will be construed as violation under the Regulations:
(i) False information or misrepresentation of facts for obtaining entry permit
(ii) Not bringing to notice of change of Driver/Cleaner in whose name the permit had been issued.
(iii) Entering a place to which one is not authorized or entering the Port when one has no bonafide business inside the Port.
(iv) Non production of entry permit when demanded by Security Personnel/Traffic Manager.
(v) Entry into/out of Port area for work in drunken condition.
(vi) Entry into Port area carrying banned items.
(b)The following acts will be construed as violation in the case of entry of vehicles/equipment, namely:
(i) Driving a vehicle without licence.
(ii) Not producing the licence to the officials of the Port for verification.
(iii) Non production of computerized pollution under control certificate at the gate and in other places of the Port.
(iv) Entry into the Port area without obtaining the entry permit.
( v) Leaving the vehicle unattended at any dock area or storage area.
(vi) Non-observance of speed limit.
(vii) Not stopping at the security gates for checking.
(viii) Parking the vehicles in the "No Parking area".
(ix) Parking the vehicle in the Dock or Storage area for more than the required time.
(x) Non-observance of one way traffic.
(xi) Damaging Port Property or causing accidents in the Port premises and/or leaving the accident spot with intention to escape.
(xii) Driving a vehicle by a person who is not authorized.
(xiii) Driving a vehicle by a person in
intoxicated condition either by use of alcoholic drinks, drugs or any
other like thing which will be identified after testing the person in the
(xiv) Parking a non-functional vehicle without the parking light during night or low visibility time.
(xv) Carrying projected articles without red lamp/red flag at the rear end.
(xvi) Driving a vehicle without number plate on either side.
6. Penalties for violation of conditions of entry permit of persons
For violation by persons in obtaining/using the entry permit, the permit of the person shall be suspended/cancelled by the Traffic Manager.
Penalties for violation of conditions of licence on vehicles:
For violation in respect of vehicles, penalty of Rs.200/- and/or banning of entry into the Port for a period of upto one week on each occasion would be imposed by the Traffic Manager. If the vehicle is found to faulting on the third occasion within six months, the vehicle will be banned entry into the Port area for a period of one month in addition to levy of fine as above by the Traffic Manager.
7 Appeal:
Any individual who suffers from the action taken by the Port for violations of the conditions in these regulations wishes to appeal against the penalty imposed, they may do so within a week's time for consideration of their case to the Chairman. Each such case will be decided by the Chairman/Port Trust based on merits.
